1. Acceptance of Terms
By booking with Mtalii Bushcamps (“we,” “our,” or “us”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms form the entire agreement between you and Mtalii Bushcamps regarding your safari experience.
2. Booking and Payments
2.1. A 30% non-refundable deposit is required to confirm your booking.
2.2. The remaining balance must be paid 60 days prior to your safari commencement.
2.3. Bookings made within 60 days of departure require full payment at time of booking.
2.4. We accept payment via bank transfer, credit card, or other methods specified on our website.
3. Cancellation Policy
3.1. Cancellations must be received in writing via email.
3.2. Cancellation charges apply as follows:
- More than 60 days: Loss of deposit
- 59-30 days: 50% of total cost
- 29-15 days: 75% of total cost
- Less than 14 days: 100% of total cost
3.3. We strongly recommend comprehensive travel insurance.
4. Health and Safety
4.1. You must disclose any medical conditions, allergies, or physical limitations during booking.
4.2. We reserve the right to refuse participation to anyone whose health or behavior may affect their safety or others’ experience.
4.3. You are responsible for ensuring you have adequate travel insurance covering medical evacuation, injury, and trip cancellation.
5. Travel Documents and Requirements
5.1. You are responsible for obtaining valid passports, visas, and vaccination certificates as required.
5.2. We are not liable for any costs or consequences resulting from improper documentation.
6. Changes to Itineraries
6.1. We reserve the right to modify itineraries due to weather conditions, wildlife movements, safety concerns, or other operational requirements.
6.2. Alternative arrangements of similar standard will be provided where possible.
6.3. No refunds will be given for minor itinerary changes or unused services.
7. Liability and Responsibility
7.1. We act as agents for accommodation providers, transportation companies, and other service providers.
7.2. We are not liable for any loss, damage, injury, or expense resulting from acts of third parties.
7.3. Participation in safari activities involves inherent risks, and you assume all responsibility for such risks.
8. Client Responsibilities
8.1. You must follow instructions from guides and staff at all times.
8.2. You are liable for any damage to property or equipment caused by negligent behavior.
8.3. We reserve the right to terminate your safari without refund for dangerous or disruptive behavior.
9. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, political unrest, terrorism, pandemics, or government travel restrictions.
10. Photography and Marketing
We may use photographs and videos taken during your safari for promotional purposes unless you provide written objection at time of booking.
11. Complaints
Any complaints must be reported immediately to your guide during the safari to allow for resolution. Complaints received after completion of safari cannot be considered.
12. Governing Law
These Terms and Conditions are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
